    1a(i)When the item is stated as  Local Australian stock and shipped locally the Customer will also be known as the "purchaser","customer"."customer's" of the goods and the same terms and conditions will apply except for Warranty which will be under the Australian Local Stock Warranty.

     

    1b When visting or browsing ryansgadgets.com.au, or when agreeing to place an Order, you the Customer agree to the Terms and Conditions of this website, The Terms and Conditions creates a legally binding Agreement between Ryans Gadgets and the Customer.

     

    1c The Agreement cannot be changed unless we agree to change it in the form of an email or text in writing

     

     Other Terms and Conditions

     

    a Ryans Gadgets can alter the website terms and conditions at its own discretion anytime with or without notice if an issue arises.

     

    b Products or Goods received upon delivery by means of signage, the Customer/Purchaser holds responsibility for the risk and title of that product

     

     

    c Ryans Gadgets has the authority or right even if any of these terms and conditions suffers from an issue or is stalled by Ryans Gadgets the power of right will not be waived. As the Future is uncertain we can make changes according to terms and conditions and will apply the power of right into the future in accordance with 14

     

    d Any terms of provisons under these terms and conditions that may not  be enforced or broken will be exempt from all other provisions without affecting the other terms or provisions being followed through.

     

    e The Terms and Conditions set out will be used for the entire website including the postage, orders,purchases and delivery of goods/products of ryansgadgets.com.au/Ryans Gadgets. These terms and conditions are set out by Ryans Gadgets and in accordance with Consumer Law Victoria

     

    f The only authorised person of Ryans Gadgets is the owner who has the ability  to change all terms and conditions regarding sales

     

    Legal Age and Area

     

    2a Ryans Gadgets will not be held responsible for persons who purchase goods under the age of 18 years by agreeing to these terms and conditions The Customer/Purchaser acknowledges that they are 18 years old  and over when placing orders

     

    2b Ryans Gadgets holds NO RESPONSIBILITY for harm caused which may occur in association with the Customer/Purchaser's use of ryansgadgets.com.au

     

    The Customer/Purchaser must guarantee and take safety measures in the process for accessing ryansgadgets.com.au. The Purchaser/Customer must make sure that they are not open to the elements of the risk of viruses(whether Trojan, Malware etc), malicious content or codes also other forms of intrusion which may harm the Customer/Purchaser's computer system.

     

     

    2c The Purchaser/Customer must make sure that the right to use ryansgadgets.com.au and the surfing of the Website ryansgadgets.com.au  is not done in a forbidden or illegal manner in accordance with the law which applies to the Customer/Purchaser

     

    3. Quotations and Prices

     

    3a Postage Costs will be shown at a separate cost to the products/goods.

    PRICES listed on ryansgadgets.com.au do not include Postage Costs.

     

    3b Ryans Gadgets PRICES can change at any time with no/ any notice at all that are displayed on ryansgadgets.com.au. Ryans Gadgets does not have a price protection policy for goods or items that have dropped in price.

     

    3c Ryans Gadgets Quotations will be valid for 14days from issue.

     

     

    4 Product Description

     

    4a Product measurement descriptions if stated on ryansgadgets.com.au are estimated only. Images contained on ryansgadgets.com.au are approximate to depict products and may not be of actual size

     

    4b Descriptions of Products can change anytime with no notice at all on ryansgadgets.com.au

     

     

    5 Information Regarding Orders

     

    5a Ryans Gadgets will  communicate with Customers mostly via email or by phone if requested by the Customer or Purchaser. The Customer's/Purchaser's responsibility is to make sure that the correct e-mail/phone/address or any form of communication details are entered as well as that

     

    5a The Purchaser's/Customer's chosen e-mail address is checked often for any communication from Ryans Gadgets

     

    5b When Orders are received by Ryans Gadgets We will notify the Customer with an order conformation email sent to the Purchaser's email which the Purchaser has provided to us. Orders will be processed within 3-5 working days excluding public holidays

     

    5bi When Placing an order you agree to be the importer (purchaser/customer) of those goods and must be able to notify Ryans Gadgets of a cancellation of an order within 24 hours of placing an odrer

     

    5c A Cancellation of an order by Ryans Gadgets/ryansgadgets.com.au can occur at any given time, place or manner regarding a Customer's or Purchaser's order before Postage or anytime before the item/product leaves the hands of Ryans Gadgets. Orders can be cancelled if any website error, pricing error or glitch occurs.

     

    5d If there is a cancellation in regards to an order, money or any electronic form of funds that is paid with that order the Customer/Purchaser will be refunded in full and the Purchaser/Customer will be notified.

     

    5e At Ryans Gadgets we will not accept any responsibility for orders/purchases that are rejected, on hold or not approved due to disruptions with network issues, configurations or types of means of connectivity or any other type of mobile and or wifi connection.

     

    5f Ryans Gadgets will not be held responsible for any delay in carrying out any of its commitments under the Terms and Conditions Agreement. Ryans Gadgets can possibly be permitted an acceptable amount of extended  time for the carrying out of commitments if there is a delay that is caused by events outside of acceptable control of Ryans Gadgets.

     

    6 Paying Funds

     

    6a If your credit card triggers fraudalent activity we may request additional details and the Customer's/Purchaser's order may be cancelled under those circumstances

     

    6b Electronic Funds or (Non Electronic Fund circumstances such as Gift Vouchers*) regarding orders are accepted promptly upon confirmation of the Purchaser's/ Customer's Order

     

    6C All Orders are accepted only in Australian Dollars AUD $ via the PayPal terminal however exchange rates are dependant on your bank but you can use http://www.xe.com/ as a guide  

     

    7.  Possession of the Goods and Delivery

     

    7a  If a date of dispatched is stated it is purely an estimated time frame by Ryans Gadgets and it can change anytime without any notification. Where there is long day we will notify Customers via their email which has been used to place the order.

     

    7b  If any cover on goods/products will be lost when a Customer gives written permission for Products to be posted without a signature

     

    7c Ryans Gadgets will not be liable for any inaccuracy of address provided by the Customer/Purchaser after dispatching of the goods or for the receiving of goods. Ryans Gadgets expects that all addresses given by the Customer/Purchaser are accurate and if any inaccuracies occur the Customer/Purchaser will be held liable for the loss of goods and the Customer/Purchaser will have to follow it up  with the given Postal service. 

     

     

    7d In some circumstances delays can occur outside of Ryans Gadgets hands regarding postage and other factors. Ryans Gadgets won't  accept any responsibility for loss or damages affected by anyone if a delay is present or occurs. Ryans Gadgets tries to make sure that goods are delivered as soon as possible and in a reasonable time frame.

     

    7e The Postage service will be delivering the Customer's/Purchaser's goods during business hours 9am - 5pm MON-FRI chosen by Ryans Gadgets. Ryans Gadgets is not accountable for the postage times of goods

     

    7f Customer must check the ZONE AREA displayed under  DELIVERY  to ensure they are in the Zone area for the shipping.  REMOTE AND OR RURAL AREAS  will incur an extra charge and you can contact us before placing an order or we will be in contact with you if an order is placed outside of that Zones listing.

    7g Postage can take up to 14 working days from dispatch dependant on holiday seasons and public holidays for DHL

    Singapore Post up to 35 days from dispatch dependant on holiday seasons and public holidays 

     

    Free Shipping up to 40 days from dispatch dependant on holiday seasons and public holidays 

     

    8 Faults or Damages of Goods

     

    8a Ryans Gadgets will abide by the Australian Consumer Law Standards

     

    8b Ryans Gadgets will not be responsible for the return postage of all goods (whether faulty or not). The Customer/Purchaser must return goods at your own cost.  All goods/products are inspected prior to packaging and postage by Ryans Gadgets or the agreed Supplier for any defects. 

     

     

    9 Refunds and Returns

     

    9a Refunds are limited to Consumer Law

     

    9b When a refund is processed it can take up to 10 working business days excluding Public  Holidays. Refunds must be authorised prior to return within 7 days of delivery. Change of mind or not satisfied returns the Item must be a non sale item and not an Overseas Direct Import Product.

     

    9c When returning goods the Customer/Purchaser must carry out a return under the Terms and Conditions set out. The Customer/Purchaser must contact Ryans Gadgets email support@ryansgadgets.com.au

     

    9d  In order to ensure a return is done in the correct manner Customers/Purchasers must follow through with the instructions given.

     

    9e Ryans Gadgets will  not take any responsibility for Products lost in transit, postage or any form of return that goes missing whether by courier or mail. The Customer/Purchaser has a responsibility to ensure that returned items are returned in a safe manner.

     

    9f Products that are returned must be in manufacturers packaging with all parts (cables, batteries etc) and have to be in a condition that is re-saleable for Ryans Gadgets.

     

    9g Customer's/Purchaser's must pay for the return postage of the goods returned for refunds.

     

    9h Goods that are modified,broken by force ,damage or neglect by the Customer will not be accepted for return. Ryans Gadgets has the right to determine whether a repair/replacement or refund will be issued.


    9i If goods are purchased within  Remote and Rural areas a surcharge fee will incur 

    9J A cancellation in an order after 24 hours will result in a restocking fee of 10% of your total purchase amount

    9k) A refund based on not accepting a Tax or Duty charge such as VAT (Value Added Tax) or any other fee will not be accepted and any return shipping will be at customers expense 

     

    10. Legal Responsibility of Ryans Gadgets

     

    10a Ryans Gadgets  has a maximum aggregate liability for any goods that has been sold or repleted to the Purchaser/Customer in contract or any other to that degree including tort law (negligence etc),to the extent in no circumstances or state of affairs surpass the amount to be paid by the Customer to Ryans Gadgets in regards to the item in dispute.

     

    10b Ryans Gadgets will not be held responsible for any loss. (in Respect to profits, loss of income, loss of contracts and or loss of data) Ryans Gadgets will not  be responsible for any  personal or circumstantial losses or damages of any kind however occurring.(caused by any legal tort law (negligence etc), breach of contract or any other to that degree)

     

    11. Privacy Area of Ryans Gadgets and or ryansgadgets.com,au

     

    The Customer/Purchaser can request data which Ryans Gadgets holds of the Customer/Purchaser in a form of a request in text or in writing sent to Ryans Gadgets. When this type of request is asked from Ryans Gadgets, Ryans Gadgets has the right to  charge administration fees for fulfilling a request of this nature. When making a purchase, ordering or making any form of contact through Ryans Gadgets the Customer/Purchaser agrees that we may use, collect,hold or process data in accordance with the order the Customer/Purchaser has placed or placing. The Purchaser or Customer agrees that we can use these details except for credit card details when informing the Customer or Purchaser of any promotions, information etc.

    For Making a request no fee will be charged. However when this type of information is asked from Ryans Gadgets, Ryans Gadgets has the right to  charge administration fees for fulfilling to cover retrieval of your personal information however such fee that is not excessive for this process.

     

    If you believe as the Customer/Purchaser feels there is information which is creating an inaccuracy, misleading, not needed or required or up to date or complete information in our customer database you may request a change in this information to Ryans Gadgets and a response will be made in a  reasonable time frame. For this type of request of correction of personal information Ryans Gadgets will not charge a fee.

     

    Ryans Gadgets may find that such personal information that is not required to be stored by law or is no longer needed by Ryans Gadgets for any purposes set out within this policy.     13 Discount Codes and Gift Vouchers*

     

    13a All Discount codes and Vouchers that are issued by other companies or persons other than by Ryans Gadgets will not be honoured. Any misuse or distribution (of vouchers and codes) or any form of hacking the voucher/code system will result in a cancellation of orders and will be reported to the relevant authorities. Ryans Gadgets will issue discount codes at its own discretion. Ryans Gadgets will be the sole distributer,advertiser and owner of Ryans Gadgets discount codes.

     

    13b.Any Gift Vouchers given by Ryans Gadgets to the Customer/Purchaser are valid for 12 months from the initial date of issue

     

    14. If any terms and conditions cause legal dispute regarding any issue whatsoever Ryans Gadgets must be given a reasonable time frame to remove such terms and change them accordingly before legal action can be taken.

    15.Warranty and terms associated with Overseas Direct Import:

    The 12 month Voluntary warranty

     

    Warranty and Terms and Conditions Regarding Overseas Direct Import Stock

     

    Definitions of these terms and conditions

     

    Overseas Direct Import Stock means overseas stock not local Australian stock which is imported by you and shipped directly to you the customer. These products are better known as Overseas Direct Imports however still perform to the same standards (in terms of function and performance) as local Australian stock and are no way any inferior or illegal.

     

    Australian Stock usually comes with an Australian Local Warranty directly from the manufacturer however Overseas Direct Import Stock comes with a voluntary warranty provided by us Ryans Gadgets in accordance with Australian Consumer Law Act.

     

    Pricing regarding Overseas Direct Import Stock is priced in AUD (Australian Dollars) and excluding GST and any applicable taxes. These Overseas Direct Import Stock Prices can change at any time with or without notice on the website.

     

    Ryans Gadgets is not associated with some of the manufacturers of these branded products and is not an official Australian reseller of some of the branded products. However we are a seller of Overseas Direct import stock which you the customer benefits from in terms of saving money on the same  goods but just from overseas with the same quality and standards as Australian stock.

     

    Ryans Gadgets warranty is abiding by the manufacturer's warranty booklet provided with each product.

     

     Ryans Gadgets at its own discretion can issue a like for like product or relevant part on a case by case basis whether  in the voluntary warranty period. Refurbished parts may be used to replace the non working parts. The balance of time period of warranty will remain and will not be restarted to a new warranty period. An alternate product can be provided and may be of a different specification, size and shape.

     

    A store credit or refund may be issued in certain circumstances and is based on a case by case basis when an item cannot be repaired or replaced. However the shipping cost will not be reimbursed only the product amount.

     

    Overseas Direct Import Stock Only:

     

    Warranty is an agreement with the customer/ importer of the goods in accordance with Ryans Gadgets ABN 30414350783 to repair or replace a product within:

    12 months of its Australian Voluntary Warranty

     

     

    Within the voluntary warranty if no proof of dispatch is provided the date will be then said to be 2 business days from the exact date of product being dispatched.

     

    Warranty is said to begin on the exact date of delivery whether by signature or non signature.

     

     

    In order to process a warranty claim the customer/importer of the goods must co operate with Ryans Gadgets set instructions in order to resolve issues in a timely manner.

     

    In certain circumstances a prepaid return postage label may be provided to a customer to send the item to the nominated supplier, repair centre or Ryans Gadgets itself for international customers this does not apply.

     

    Products sent to the nominated repair centre or supplier are at the customers sole risk and must ensure that the item is sent correctly and in a safe manner.

     

    Ryans Gadgets holds the ability to determine if a product is performing up to the specifications specified by Ryans Gadgets.

     

     

    Taxes

    The Importer (You the Customer) are responsible for all taxes and charges associated  with tax regulations and customs  Authorities  in Australia or from the respective country it is shipped from when applicable. Regarding border and customs processing the purchaser is the importer of the goods and will be liable for any regulations and taxes associated. However Any goods imported into Australia below $1000 AUD (Australian Dollars) do not incur GST or Imported Taxes when made in a single purchase . Multiple purchases of $1000 AUD at the same time may lead to applicable import duties and taxes which you the importer of the goods (the customer) is liable.


    International Customers:


    Taxation is calculated based on your countries laws and duties, fees etc

    Overseas Direct Import Warranty

     

    DOA (DEAD ON ARRIVAL) /ELF(END OF LIFE) period commences within the first 48 Hours of receiving the goods (Signed for or collected or received)

     

    Repairs for phones could be sent back to Ryans Gadgets the nominated Repair Centre or the Supplier Directly and  is assessed on a case by case basis depending on the fault. However we endeavour to solve the issue as soon as possible. Assessment will be conducted within 48 hours of receiving the returned goods back to Ryans Gadgets however when sent back to the supplier or nominated repair centre in some cases may take longer.

     

    Repair guarantee within a 30 day period based on a case by case basis

     

     

    Dead On Arrival (DOA) items must be reported to Ryans Gadgets within 36 hours of signature, received or collection of goods. The items must be received by Ryans Gadgets in its original new condition (100%) and not a second hand or used condition. Pictures of any such damage or issue must be sent to us within the set period to support@ryansgadgets.com.au.

     

    Dead On Arrival goods will be repaired if cannot be done replaced or refunded

     

    Circumstances when Dead On Arrival will not be accepted:

     

    Items that are tampered with by means of software (rooting,hacking  damaging or destroying the OS(Operating system) or flashing with custom roms etc)

     

    Items that have liquid damage or physical damage

     

    When Ryans Gadgets are provided with a written quote for repair of the item the customer will be charged for the service fee,postage and repair parts.

     

    Dead Pixel Policy

     

    When there are less than 10 dead pixels on the screen of a device whether LCD or AMOLED WON'T be included as Dead On Arrival (DOA) as Manufacturers do not offer a repair for this  nor replacement or refund unless the dead pixels are found precisely to be at the exact middle of the screen

     

    Ryans Gadgets offers a 12 month Australia Wide Warranty on these types of Goods (voluntary warranty)

     

    Return postage may be paid by the customer or by Ryans Gadgets based on a case by case basis. However the sending of an item to a designated repair centre is paid by the customer.

     

    Warranty Claim Procedure:

     

    The original importer of the goods (customer) needs to email support@ryansgadgets.com.au  promptly or ASAP (As soon as possible) for instructions and a return authorisation regarding how to repair or replace the item. You must include your Contact Name, copy of  the original invoice, IMEI number, Tracking Number, Order No, Date of Purchase, Contact Details and the description of the item and fault.. When a return authorisation is approved we will issue you with an RMA Code which the affected part or item needs to be returned to the nominated repair centre chosen by us. The goods must be returned before the warranty is up or expires. When making a limited warranty  claim you need to provide IMEI, Serial number, Original Invoice legible and unmodified proof of purchase with address and name and the affected part or item. This warranty applies to the orginal purchaser (Importer) of the goods and is not transferable to any other party or purchaser. Only you the importer (purchaser) can claim this warranty.

     

    Exclusions within this Limited Warranty in addition to the exclusions set out in the standard manufacturer's warranty booklet (Ryans Gadgets is not associated with the manufacturer)

     

    Ryans Gadgets will not warrant that the software or operating system will meet your expectation or requirement nor in any mixture or dual booting ( a two system software system) or multiple software running on the device provided by a 3rd Party or software applications provided by such a 3rd party. (this includes applications from the App store relevant to the device)

     

    Ryans Gadgets will not warrant software glitches, errors or if software is continuous and error free

Not adhering to the manufactures instructions on correct use of the product (Manufacturers what to do and what not to do as set out in the guide or manual) or any other aspects or acts out of Ryans Gadgets control.  

     

    Software updates that cause major errors and alters the function of the device

     

    The Limited Warranty  does not cover:

    Batteries that have been short circuited, damaged or electronically shocked (power surges etc) or destroyed by such means or damage to the cells of the battery that shows tampering or misuse (the battery enclosure or seal)

     

    Batteries that have been used in other devices other than the original device that cause defects

    Alleged defects or defects when an item is used in conjunction or connected with another product or item. This can be hardware, software, devices, computers or any electronic or non electronic device that is not approved by Ryans Gadgets to be used with that device or else not used for its intended use.

    Viruses, malware , hacking or unauthorised access to accounts networks or services whether through any installation, mainframe networks, wireless networks or any type of internet connection or non internet connection use that affects the device any such manner regarding such defects.

    If the devices serial number/IMEI number/ or codes that has been altered in any way or form or has been marked, covered, obscured or missing and illegible

    If the item (mobile phone etc) has been modified, repaired (even using any other parts that are not authorised by Ryans Gadgets) or opened other than by Ryans Gadgets authorised repair centre.

     

    What can happen if the item is not faulty and in working order and you make an inaccurate claim?

    Ryans Gadgets will seek reimbursement from the purchaser or customer and they will be billed the associated fees

These products are better known as Grey Imports however still perform to the same standards (in terms of function and performance) as local Australian stock and are no way any inferior or illegal.

     

    Australian Stock usually comes with an Australian Local Warranty directly from the manufacturer however Overseas Direct Import Stock comes with a voluntary warranty provided by us Ryans Gadgets in accordance with Australian Consumer Law Act.

     

    Pricing regarding Overseas Direct Import Stock is priced in AUD (Australian Dollars) and excluding GST and any applicable taxes. These Overseas Direct Import Stock Prices can change at anytime with or without notice on the website.

     

    Ryans Gadgets is not associated with the manufacturers of these branded products and is not an official Australian reseller of the branded products  however we are a seller of grey import stock which you the customer benefits from in terms of saving money on the same  goods but just from overseas with the same quality and standards as Australian stock.

    9 Refunds and Returns

     

    9a Refunds are limited to Consumer Law

     

    9b When a refund is processed it can take up to 10 working business days excluding Public  Holidays. Refunds must be authorised prior to return within 7 days of delivery. Change of mind or not satisfied returns the Item must be a non sale item and not an Overseas Direct Import Product.

     

    9c When returning goods the Customer/Purchaser must carry out a return under the Terms and Conditions set out. The Customer/Purchaser must contact Ryans Gadgets email support@ryansgadgets.com.au

     

    9d  In order to ensure a return is done in the correct manner Customers/Purchasers must follow through with the instructions given.

     

    9e Ryans Gadgets will  not take any responsibility for Products lost in transit, postage or any form of return that goes missing whether by courier or mail. The Customer/Purchaser has a responsibility to ensure that returned items are returned in a safe manner.

     

    9f Products that are returned must be in manufacturers packaging with all parts (cables, batteries etc) and have to be in a condition that is re-saleable for Ryans Gadgets.

     

    9g Customer's/Purchaser's must pay for the return postage of the goods returned for refunds.

     

    9h Goods that are modified,broken by force ,damage or neglect by the Customer will not be accepted for return. Ryans Gadgets has the right to determine whether a repair/replacement or refund will be issued.


    9i If goods are purchased within Remote and Rural areas a surcharge fee will incur 

    9J A cancellation in an order after 24 hours will result in a restocking fee of 10% of your total purchase amount

    9k) A refund based on not accepting a Tax or Duty charge such as VAT (Value Added Tax) or any other fee will not be accepted and  any return shipping will be at customers expense
